Types of Variances
Collier County recognizes two main types of variances. A dimensional variance allows deviation from physical requirements like setbacks, height limits, or lot coverage percentages. A use variance allows a property to be used in a way not typically permitted in its zoning district — these are more difficult to obtain.
When You Might Need One
Common scenarios include building closer to a property line than the zoning code allows, exceeding maximum building height for your district, wanting to build on an irregularly shaped lot, or adding a structure that exceeds the maximum lot coverage percentage.
The Application Process
Variance applications in Collier County are submitted to the Zoning Division. The process involves completing a detailed application, providing a survey and site plan showing the requested deviation, writing a justification narrative, paying applicable fees, and attending a public hearing before the Board of Zoning Appeals.
Criteria for Approval
The Board evaluates requests based on several factors: whether the property has unique physical characteristics creating a hardship, whether the variance is the minimum deviation necessary, whether it will negatively affect neighboring properties, and whether the hardship was not self-created.
